CPL Terms and Conditions

Please read these Terms and Conditions (hereinafter: "Terms", "Terms and Conditions") carefully before using the Croatian Poke League application (hereinafter: the "Service") operated by Snow Studios (hereinafter: "us", "we", or "our").
By accessing or using any part of the Service, you accept, comply and agree to become bound with these Terms and Conditions. If you disagree with any part of these Terms and Conditions, then by all means you may not use the Service at all. These Terms and Conditions apply to all visitors, users and all other who choose to access or use the Service.
1. Advertisement
Snow studios reserve the right to display advertisements on the Service.
2. Links to, and use of, Third Party
Our Service may or may not contain links to other sites that are not controlled nor operated by us. If you choose to click on a third party link, you will be directed to that third party’s website. As we don’t have any control over those websites and their content we assume no responsibility for that content, their privacy policies or practices. However you further acknowledge and agree that Snow Studios shall by no means be responsible or liable, in any way directly or indirectly, for absolutely any kind of damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or websites available on or through any such websites.
We therefore strongly encourage you to review the Privacy Policy and read the terms and conditions of absolutely any third-party website you visit.
3. Copyright Infringement and DMCA
Snow studios respect intellectual property rights of others and therefore expect others to respect our intellectual property rights as well. If by any means you believe that material which is located on our Service or linked to by our Service violates your copyright, we encourage you to notify us in accordance with Snow Studios Digital Millennium Copyright Act (“DMCA”) Policy. We will try to respond to all such notices in a reasonable amount of time, if required we will also remove the infringing content or disable all links to such content.
4. Intellectual Property
The Service, the logo of our Service and all other trademarks, service marks, graphics designs which are used in connection with the Service are our own trademarks. There can be other trademarks, graphics designs or logos which are used in connection with the Service but are actually trademarks of other third-parties. Your use of the Service gives you no right nor does it give you the license in order to reproduce or any other way use any of the trademarks found on the Service.
5. Disclaimer of Warranties and Limitation of Liability
The Service is provided “as is”. Snow studios hereby disclaim all warranties of any kind, express or implied, which also includes without limitation any kind of warranties of merchantability, fitness for a particular purpose, compatibility, security, accuracy and non-infringement.
To the extent permitted by law, Snow studios will not be liable for any indirect loss or damage arising out of or in any connection with the use of the Service.
Snow studios gives no warranty by any means that the Service will be without errors or that the access to the Service will be non-stop or uninterrupted. Snow studios also makes no warranties that the errors will be corrected or that the Service is free of viruses or anything else which can be in some way harmful or destructive. You should therefore take to note da you do obtain content or websites through the Service at your own risk and discretion.
Take to note that Snow studios is not liable for death, personal injury or any other kind of unfortunate event which happens to be a result of the negligence of Snow studios.
In no event shall Snow studios be liable for any kind of damages that result from the use of, or the inability to use, the Service and any of the products which are offered in the application. Snow studios shall also not be liable for any kind of damages which can be a result of poor performance of the Service or the products which are offered on the Service.
Snow studios will under no circumstances be liable for any users’ or visitors activities.
6. Indemnity
You agree to indemnify, defend and hold Snow studios, its employees and any third party providers of information the Service harmless from and against all losses, expenses, liabilities, legal fees, and damages, costs resulting from any violation of these Terms in relation to any claims or actions brought against the Service. In case that Snow studios is anyhow brought to any claim for which we do have the right to be indemnified by you, we will have the right to, of course at your expense assume the exclusive defense and control of any such claim.
7. Termination
Snow Studios may terminate or suspend your access to our Service at any time, without any prior notice, for any reason whatsoever, effective immediately if in any case you breach the Terms and Conditions of this Service.
If you wish to terminate this Agreement, you may simply discontinue using the Service or contact us.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
8. Governing Law
Any access to or use of the Service will be governed by the Croatian law and court in Zagreb, Croatia. Any dispute arising under this Terms shall be governed by the Croatian law and court in Zagreb, Croatia.
These Terms shall be governed and construed in accordance with the laws of Croatia, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, that part will be construed to reflect the parties’ original intent, and the remaining provisions of these Terms will remain in full force and effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
9. Changes
Snow Studios reserves the right, at its sole discretion, to modify or replace any part of these Terms at any time. It is your responsibility to check this Terms periodically for any changes. If a revision is material we will try to provide at least 30 days’ notice prior to any new terms taking effect, but we reserve the right not to give any notice. What constitutes a material change will be determined at our sole discretion.
Your continued use of or access to the Service after those revisions become effective, you agree to be bound by the revised terms. If you disagree with any part of these new Terms and Conditions, then by all means you may not access the Service or use any services provided there.
